GENERAL CONDITIONS OF HIRE TOR LEISURE – GENERAL CONDITIONS OF HIRE, ENTRY AND USE
Any Hirer, user, tradesman, customer, client, club or guest (hereinafter referred to as the client) shall take all reasonable precautions to ensure that no damage occurs to the property or its employees. In the event of any damage occurring the Management of Tor Leisure reserves the right to render the client liable for replacement or repair of any or all property damaged.
CHILDRENS PARTIES
These must be paid for in full prior to the event to ensure the space is available.Only when the full amount is paid can a booking be confirmed.
LIVE MUSIC
All live music events must be booked at least 21 days prior to the event due to Licensing Act 2003.An assessment is made for each event to establish the need for SIA door staff which is invariably a requirement.
The hirer at the time of booking must pay the full cost of the door staff along with any other charges to confirm the booking of the venue.
PARTIES
A minimum non returnable deposit of £60.00 must be paid at the time of booking to ensure the hirers preferred date is secured. A further deposit may be required on assessment and if the hire goes ahead as planned this will be kept as a security deposit and returned after the event has taken place, provided that no additional cost for damages or clean-up are incurred.
The client shall be responsible for all damages, breakages, etc. occurring during or arising from the hiring of the premises, for guests or any person who is directly or indirectly associated with the event for which the premises are being used.
The further deposit will be set against any damages incurred as a result of the use of the premises by the hirer or the guests of the hirer, and shall be forfeited in whole or part thereof should damage occur. Should the cost of damages exceed the value of the security deposit the client will be billed accordingly and settlement must be made with in 14 days. Interest at the statutory rate will be charged on late payments.
In the event of any members of staff being injured by the client or anyone attending the event, the client shall be liable for any claims arising therefrom.
The Management of Tor Leisure accept no responsibility for cancellations caused by circumstances beyond their control. Management and staff exercise the right to refuse admittance of any individual or group to the premises at any time.
Tor Leisure is located in a noise sensitive neighborhood.The client must ensure that their guests do not create noise or disturbance outside the building (such as car Hi Fi systems, slamming doors, shouting, anti – social behaviour etc. in the car park).Furthermore, any vehicle, caravan or unmotorised container left on the premises without consent will be secured and charged £10 per 24 hours left on site or increment thereof.
It is not permitted to bring the following items into the premises: Pyrotechnic, laser, firework effects or devices, glass, animals,(other than registered Guide dogs or assistance dogs and only with consent from the Management) knives, weapons or any thing that can be construed as a weapon or could cause damage to on site equipment or residents property or create a potential Environmental Health or Health & Safety hazard.
It is not permitted to bring onto the premises under any circumstances without prior arrangement any containers of any description containing part or wholly alcoholic beverage content for unauthorised consumption on any part of the licensed premises including all buildings and structures.
The client shall ensure that the function is conducted in an orderly fashion without causing a nuisance and in full compliance with the directives and requirements of the Management of Tor Leisure and with all applicable laws, ordinances and regulations.
The Management of Tor Leisure cannot accept responsibility for any equipment, provided by, for, or on behalf of the client, left unattended prior to, during or after the function.
The client acknowledges that any such objects, equipment, furniture, stock, or other property of any sort will remain under the control and care of the client and that the client is in the best position to insure such property and accordingly it is reasonable for the Management of Tor Leisure to exclude liability for such property to the extent excluded hereby.
If for any reason beyond its control, but not limited to strike, labour dispute, accident, act of war, act of God, fire, flood or other emergency condition, the Management of Tor Leisure is unable to perform its obligation under this Agreement, such non-performance is excused and the Management of Tor Leisure may terminate this Agreement without further liability of any nature, upon return of the customer’s deposit. In no event shall the Management of Tor Leisure be liable for consequential damages of any nature for any reason whatsoever.
By acceptance of these terms and conditions, the client indemnifies the premises against any loss, claim, damage, costs or expenses suffered by or made against them however and by whomsoever caused (including but not limited to the negligence of the organiser, his servants or agents) arising from the event subject only to the extent to which such loss, claim, damage, costs or expenses arise wholly or in part from negligence on the part of the venue.
